The amount of arrogance it takes to write on this topic and not know something so basic is actually kind of mind-boggling to me. McLaughlin argues about Senate Rules the way a lawyer who doesn’t know how to look up an actual statute would argue about what the law really says.

Agreed. Mass surveillance violates the Fourth Amendment and has a chilling effect on freedom of expression. Surveillance systems are prone to misuse for political or discriminatory purposes.
