Our review specifically concerned user posts containing links that facilitate access to videos depicting animal cruelty.

We also understand your explanation that the platforms operate primarily as text-based forums and that images or videos are not directly uploaded to your servers. However, the concern in this case is that the forums hosted posts that linked users to external locations where illegal animal cruelty content could be accessed. Hosting or facilitating the distribution of links to such material still constitutes a violation of Epik’s Terms of Service.

We appreciate that you have described an existing process for reporting and removing problematic content and that records of deletions are maintained. However, as the domain owner and operator of the platform, responsibility for moderating content on the domain ultimately rests with you. In the course of our review we observed links on http://5ch.net
that had remained publicly accessible for extended periods of time — in some cases approaching five years — as well as newly posted content of a similar nature on http://bbspink.com
. This indicates that the moderation process in place did not sufficiently address the presence of this material.
