Wong Kim Ark, 169 U.S. 649 (1898) as well as Ex parte McCardle, 74 U.S. 506 (1868/1869), a landmark in American constitutional law regarding the Supreme Court's appellate jurisdiction and the power of Congress to limit it.
Following the Civil War, Congress passed the Reconstruction Acts, placing the South under military rule. William McCardle, a Mississippi newspaper editor, was imprisoned by a military tribunal for publishing articles critical of the Reconstruction government.
This argument today was defined in the 19th century. President Trump is effectively reconstructing the Constitution by resurrecting laws and forcing the Supreme Court to litigate them.
