Optional Practical Training (OPT) lets F-1 students work in the U.S. for 1–3 years after graduation, mostly as a bridge to an H-1B work visa. The catch: the student has to be employed in their field, but enforcement is nonexistent.
The school updates a checkbox in SEVIS (the federal student tracking system) based on what the student reports, and the employer is largely taken at their word.. The scam: a shell "employer" charges the student a few hundred dollars a month in exchange for paperwork showing they're meaningfully employed... job letters, fake training plans, sometimes fake payroll. That keeps the student legally in status.
Why students pay in: the H-1B is a lottery with maybe a 25–30% selection rate, so most lose, sometimes multiple years running. Meanwhile a 90-day unemployment limit on OPT can terminate their status. Many have families back home who spent $50K–$200K on a U.S. degree expecting it to lead somewhere. Paying a shell for fake employment is cheaper than going home empty-handed.
How it gets caught: one shell can have hundreds of "students" listed as employees across SEVIS records at various universities. But on IRS filings, state business records, and payroll taxes, the same company reports only a handful of real employees, because reporting 500 would trigger immediate scrutiny and real tax liability. ICE cross-matches the two databases, and the shells fall out.
