EXPANDING AMERICANS’ FREEDOM TO FIX THEIR OWN VEHICLES: Today, President Donald J. Trump signed a Presidential Memorandum expanding Americans’ freedom to fix their own vehicles.
The Memorandum directs the Administrator of the Environmental Protection Agency (EPA) to issue guidance clarifying what actions individuals may take to fix their own vehicles’ emissions systems, consistent with the Clean Air Act.
The Memorandum directs the EPA Administrator to encourage and expedite alternative certification pathways for aftermarket parts, reducing reliance on California’s slow and costly certification process and providing greater certainty to manufacturers and consumers. The Memorandum instructs the EPA Administrator to consider deprioritizing civil enforcement actions against individuals who, in good faith, attempt to fix their own vehicles to their original configuration.

The Biden Administration’s crushing environmental regulatory burdens caused the average cost of vehicles to soar, squeezing American families both at the dealership and in the repair shop. The only certification process currently recognized under the Clean Air Act is run by the California Air Resources Board (CARB) – a process that now routinely takes well over a year to complete, even when all paperwork and testing are in order. Because CARB’s process is effectively the only accepted certification pathway, the supply of compliant aftermarket parts has been bottlenecked by a single state agency, driving up costs, limiting supply, and reducing consumer choice.
