Both the USS Cole, and the 9/11 cases have amounted to a trial within a trial about the CIA detention and "enhanced interrogation program" which included waterboarding.
Years have been spent in pre-trial litigation about classification issues, and deciding how to deal with the years these defendants spent in the CIA black sites.
Because of these delays, the families have waited for justice longer than their children were alive.
