Good! Supreme Court Upholds Right To Sue Public Nursing Homes Over Abuse

The Supreme Court upheld an individual right to sue public nursing homes for violated rights protected under a federal law that sets standards for these institutions.

The court affirmed an appeals court ruling in a 7-2 decision that found a private individual can sue for rights protected by the Federal Nursing Home Reform Act through Section 1983 of the federal code, which allows someone to sue for their federal civil rights.

The case arose after a man named Gorgi Talevski moved into a county-owned nursing home in Indiana in 2016. Talevski had dementia that his family was unable to care for, but he was able to talk, feed himself, walk and recognize his family.

But Talevski’s condition significantly deteriorated that year, and his family learned that the nursing home, Valparaiso Care and Rehabilitation, was chemically restraining him. The medications were later reduced and allowed him to be able to feed himself again.

The nursing home later asserted that Talevski was harassing female residents and staff and began sending him to a psychiatric hospital, according to the court’s ruling. But it eventually tried to force him to permanently move to a dementia facility without notifying him or his family.

Talevski’s wife, Ivanka, sued the nursing home, its manager American Senior Communities LLC and the Health and Hospital Corporation of Marion County (HHC), arguing that they violated her husband’s civil rights protected by the federal nursing home law.

The US Supreme Court on Thursday morning ruled that nursing home residents and their survivors can sue publicly owned facilities to protect their rights under the Federal Nursing Home Reform Act.

The ruling, experts had predicted, could have far-reaching implications for millions of people, beyond those living in nursing homes, who rely on all kinds of federal benefits managed by government partners.

In Bold Act Of TREASON, FBI Used Twitter To Help Foreign Governments Target American Journalists

The Federal Bureau of Investigation has aided a Ukrainian intelligence effort to censor social media users and obtain their personal information, leaked emails reveal.

In March 2022, an FBI Special Agent sent Twitter a list of accounts on behalf of the Security Service of Ukraine (SBU), Ukraine’s main intelligence agency. The accounts, the FBI wrote, “are suspected by the SBU in spreading fear and disinformation.” In an attached memo, the SBU asked Twitter to remove the accounts and hand over their user data.

The Ukrainian government’s FBI-enabled targets extend to members of the media. The SBU list that the FBI provided to Twitter included my name and Twitter profile. In its response to the FBI, Twitter agreed to review the accounts for “inauthenticity” but raised concerns about the inclusion of me and other “American and Canadian journalists.”

The FBI’s attempt to ban Twitter accounts at the request of Ukrainian intelligence is among the most overt requests for censorship revealed to date in the Twitter Files, a cache of leaked communications from the social media giant.

The FBI’s censorship request was relayed in a March 27th, 2022 email from FBI Special Agent Aleksandr Kobzanets, the Assistant Legal Attaché at the US Embassy in Kyiv, to two Twitter executives. Four FBI colleagues were copied on the exchange.

“Thank you very much for your time to discuss the assistance to Ukraine,” Kobzanets wrote. “I am including a list of accounts I received over a couple of weeks from the Security Service of Ukraine. These accounts are suspected by the SBU in spreading fear and disinformation. For your review and consideration.”

The listed Twitter profiles, the SBU alleged, have been “used to disseminate disinformation and fake news to inaccurately reflect events in Ukraine, justify war crimes of the Russian authorities on the territory of the Ukrainian state in violation of international law.”

In order “to stop Russian aggression on the information front,” the SBU continued, “we kindly ask you to take urgent measures to block these Twitter accounts and provide us with user data specified during registration.”

The SBU expressed its “gratitude for the existing level of interaction.”

If granted, the users on the list would not only have been banned from Twitter but had their phone number, date of birth, and email address disclosed to both the FBI and SBU.

In response, Yoel Roth, Twitter’s then-Head of Trust and Safety, informed Special Agent Kobzanets and his FBI colleagues that Twitter would “review the reported accounts under our Rules.” But he warned that the list included “a few accounts of American and Canadian journalists (e.g. Aaron Mate).” Therefore, Roth said, Twitter’s review would “focus first and foremost on identifying any potential inauthenticity.”

The FBI’s National Press Office also declined to answer questions. Among several queries, I invoked Twitter’s warning that the FBI’s “assistance to Ukraine” entailed censoring journalists, and asked if that has prompted any changes to the bureau’s collaboration with Ukrainian intelligence.

Robert F. Kennedy Jr. Is The Only Democrat Running For President Who Wants To Save America

In a special Twitter Spaces discussion with Elon Musk this week, 2024 presidential hopeful Robert F. Kennedy Jr. revealed more of his platform, clearing up misconceptions some people have about his views on gun rights, border security, foreign conflicts, and more.

Unlike most other Democrats, Kennedy supports free speech and the First Amendment, for one. He expressed gratitude to Musk for at least starting the difficult job of rooting out censorship, even if he has made some questionable decisions as of late.

“Free speech and the free flow of information is the water, the sunlight, the fertilizer, and the soil of democracy – without it, democracy withers and dies,” Kennedy said, still mischaracterizing the United States as a democracy, but that is okay – we are all still in the learning process and he seems to have the right idea nonetheless.

If elected president, one of Kennedy’s first orders of business will be to sign an executive order prohibiting the government from what it is currently doing under fake president Joe Biden, from whom we received the massive Censorship Industrial Complex that is tyrannizing us all, especially online.

As for the Second Amendment, Kennedy wants people to know that he absolutely supports the right to bear arms. He recognizes that most mass shootings are not what they seem, and often seem to stem from the culprit’s use of dangerous psychiatric pharmaceuticals.

As for America’s porous southern border, Kennedy wants to seal it up while still offering humanitarian aid to legitimate foreigners in need of asylum. No longer will fighting-age men from rogue nations be allowed to pour through the border unabated while using women and children as their human shields.

“I’m actually going to the border tonight,” Kennedy revealed about his immediate plans regardless of what happens in 2024. “I’m crossing the border around 3am into Mexico. And I’ll be talking with people on both sides of the border and talking to the stakeholders.”

“Over the next three days be meeting with people from the border patrol and elsewhere to try to formulate policies that will seal the border permanently,” he added.

Kennedy was actually joined by former Democrat Tulsi Gabbard who alongside him also addressed the Wuhan coronavirus (Covid-19) and other potential bioweapons that the deep state is likely cooking up here or overseas. Both Gabbard and Kennedy want to shut down these dangerous programs immediately to protect the public from another covid type of situation.

“Covid was clearly a bioweapon,” Kennedy clarified, reiterating his position that the alleged “virus” never required the stripping of Americans’ rights and liberties in order to abate.

“The CIA continued to secretly develop bioweapons,” Kennedy added about how this is an ongoing threat. “After 2001, we passed the Patriot Act and launched the bioweapons arms race … we should shut the whole thing down.”

Corrupt DOJ & FBI Indict Trump Over Documents All Current And Former Presidents Have Access To

Former President Donald Trump on Thursday posted on Truth Social that he's been indicted, "seemingly over the Boxes Hoax," and that he's been summoned to appear at the Federal Courthouse in Miami on Tuesday at 3pm.

According to the NY Times, Trump faces seven charges, and is expected to surrender himself to authorities in Miami on Tuesday.

I have been summoned to appear at the Federal Courthouse in Miami on Tuesday, at 3 PM. The indictment reaches back to the end of Mr. Trump’s term in January 2021, when the documents — many of which were said to be in the White House residence — were packed in boxes along with clothes, gifts, photos and other material, and shipped by the General Services Administration to Mar–a-Lago.

After lengthy efforts by the National Archives throughout much of 2021 to get Mr. Trump to turn over the material he had taken with him — considered government property under the Presidential Records Act — Mr. Trump turned over 15 boxes of material in January 2022. The boxes turned out to contain highly sensitive material with classified markings, prompting a 'Justice' Department investigation.

Last August, federal agents descended on Mar-a-Lago to conduct an extraordinary search that turned up material that Mr. Trump had failed to turn over in response to a subpoena months earlier demanding the return of any classified documents still in his possession.

According to sources familiar with the case, the DOJ declined to delay the planned indictment of Trump to investigate allegations that a senior prosecutor on the case tried to influence a key witness by discussing a federal judgeship with the witness' lawyer, Just the News reports.

The 'Justice' Department has repeatedly questioned Mr. Trump’s level of cooperation with the efforts to recover the documents, saying that it had recovered more than 100 documents containing classified markings even after an attestation by one of Mr. Trump’s lawyers that a “diligent search” by his legal team had not turned up any further materials.

They will rely heavily on a U.S. District Court case in Washington more than a decade ago involving former President Bill Clinton that concluded a president had broad and mostly unchallengeable power to determine which documents from his presidency can be kept personally and that any documents moved to Trump’s homes in Mar-a-Lago, Fla., and Bedminster, N.J., fall under that category.

An American Bar Association report in 2022 seemed to agree with Trump’s assertion that “guidelines support his contention that presidents have broad authority to formally declassify most documents that are not statutorily protected, while they are in office.” -Just the News

The owner of two of the biggest hotels in the city is bailing out, and he is citing the same reasons that so many other businesses have in recent months.

Emmy Hise, senior director of hospitality analytics at CoStar, provided San Francisco Chronicle with a reality check that San Francisco hotels, at least 30, are facing loans due in the next two years.

The “primary driver” of deposit flight came from uninsured deposits, says the FDIC, as people moved to protect capital that is above the $250,000 FDIC insured maximum.

Case in point – the amount of insured deposits held by banks actually increased during the quarter as people diversified their risk.

The mass exodus follows the failures of Signature Bank, Silicon Valley Bank and First Republic, which were triggered in large part by the Federal Reserve’s aggressive interest rate hikes.

As depositors leave the banking system, money market funds have witnessed massive weekly cash inflows.
