Good! Federal Court Upholds Tennessee Law Protecting Children From Sexual Groomers, Genital Mutilation

Tennessee is likely to succeed in defending in court the state’s prohibitions on minors receiving transgender drugs and surgeries, a three-judge panel of the Sixth U.S. Circuit Court of Appeals ruled on Saturday.

Chief Judge Jeffrey Sutton, joined by Judge Amul Thapar, ruled against a preliminary injunction to halt enforcement of Tennessee’s law, which was set to go into effect on July 1.

Sutton wrote that the state is likely to win on the merits of the case, and he argued that federal judges should not insert themselves into the debates about transgenderism and seek to impose a view on all 50 states.

Challengers to the law tried to argue that “the law likely violated the Equal Protection and Due Process Clauses,” but Sutton ruled that “the challengers do not argue that the original fixed meaning of either the due process or equal protection guarantee covers these claims.”

He warned against judicial activism, writing:

"That prompts the question whether the people of this country ever agreed to remove debates of this sort—about the use of new drug treatments on minors—from the conventional place for dealing with new norms, new drugs, and new technologies: the democratic process. Life-tenured federal judges should be wary of removing a vexing and novel topic of medical debate from the ebbs and flows of democracy by construing a largely unamendable federal constitution to occupy the field."

The judge also wrote that the challengers did not have case law in their favor; instead, “they seek to extend the constitutional guarantees to new territory.”

“The burden of establishing an imperative for constitutionalizing new areas of American life is not—and should not be—a light one,” he ruled.

“Tennessee’s interests in applying the law to its residents and in being permitted to protect its children from health risks weigh heavily in favor of the State at this juncture,” he concluded.

Dr. Gal Luft, the "missing witness" from the Biden corruption investigation, told the NY Post last week that he was arrested in Cyprus to stop him from testifying in front of the House Oversight Committee that the Biden family received payments from individuals linked to Chinese military intelligence, and that they had an FBI mole who shared classified information with the Biden benefactors from the China-controlled energy company CEFC.

“I told the DOJ that Hunter was associated with a very senior retired FBI official who had a distinct physical characteristic — he had one eye,” Luft said.

That FBI official is widely believed to be former FBI Director Louis Freeh, who gave $100,000 to a trust for two of then-Vice President Joe Biden’s grandchildren in 2016 shortly before telling Hunter, “I would be delighted to do future work with you.”

The 14-minute video recording was obtained exclusively by The New York Post, in which the fugitive and former Israeli army officer Dr. Gal Luft, claims he was arrested in Cyprus to stop him from testifying to the House Oversight Committee that the Biden family received payments from individuals with alleged ties to Chinese military intelligence and that they had an FBI mole who shared classified information with their benefactors from the China-controlled energy company CEFC.

Now, Biden's DOJ has charged Luft with failing to register under the Foreign Agents Act (FARA), as well as Iranian sanctions violations. He's alleged to have conspired with others to act in China’s interest, including recruiting and paying a former high ranking U.S. government official to support policies beneficial to China.

One of the charges against Gal Luft is for foreign agent violations. Same charge the Hunter Biden was investigated for but which federal prosecutors declined to bring.

Luft was also charged with conspiracy to illegally sell weapons to Chinese individuals and companies, as well as aerial bombs and rockets to the UAE, Chinese weapons to Kenya, and Iranian oil to other countries in violation of sanctions.

He was initially arrested Feb. 17 in Cyprus, but fled after being released on bail.

Mr. Luft had been an advisor to CEFC China Energy, and told FBI prosecutors in Brussels in 2019 that CEFC had given Mr. Hunter Biden and his uncle James Biden monthly payments of $100,000 and $65,000 in exchange for using their names to promote Chinese business interests, according to the Post.

Sen. Ron Johnson (R-Wisc.) said on Fox News recently that Mr. Luft should have the opportunity to testify on this case before Congress.

Ukrainian President Volodymyr Zelenskyy received a hero’s welcome at a concert in Lithuania’s capital where he arrived Tuesday to meet with NATO leaders.
Instead of going straight to the military alliance’s summit in Vilnius, Zelenskyy stopped in the city’s downtown where thousands of people had gathered for a concert organized by civil society groups in support of Ukraine.
Zelenskyy stepped onto the stage with his wife to loud cheers. When he opened his speech with the Ukrainian national salute “Glory to Ukraine!” the audience delivered back the traditional Ukrainian response “Glory to the heroes!”
The Ukrainian president, who was to meet with NATO leaders Wednesday, had earlier expressed deep frustration that the alliance was providing no firm timetable for when his country could join, calling that “absurd.” In his emotional speech in downtown Vilnius, Zelenskyy appealed for a clear pathway and timeline for Ukraine.
“Today I started my journey with faith in solutions, with faith in strong partners, with faith in NATO … in a NATO that does not hesitate, that does not waste time and does not look over their backs at any aggressor,” Zelenskyy said.
“I would like this faith to become confidence, confidence in the decisions that we deserve, all of us, every soldier, every citizen, every mother, every child,” he said. “Is that too much to ask?”
