Kroger has alarming plans for digital price tags, lawmakers say
The grocery giant is under investigation.

In 2018, Kroger first announced that it was reimagining price tags in some of its stores. In roughly 200 of its locations, the company revealed, it will be switching out its paper price tags for digital ones, which would allow employees to update prices for items within seconds.
After Kroger (KR) recently expanded this technology in hundreds of more stores last year in an effort to save paper and improve the experience of shoppers, a few lawmakers are beginning to grow suspicious of the company’s real intentions.
In an Aug. 5 letter to Kroger CEO Rodney McMullen, U.S. Sens. Elizabeth Warren, D-Mass., and Bob Casey, D-Pa., revealed that they will be launching an investigation into the company’s digital price tags as they are worried that the new technology will open the door for price gouging.
“These digital price tags may enable Kroger and other grocery chains to transition to ‘dynamic pricing, in which the price of basic household goods could surge based on the time of day, the weather, or other transitory events – allowing stores to calibrate price increases to extract maximum profits at a time when the amount of Americans’ income spent on food is at a 30-year high,” reads the letter.
The senators also flagged that in February, Kroger began working with Intelligence Node, a company that uses artificial intelligence to “provide dynamic pricing and market analytics solutions.”
They also claim that Kroger’s partnership with Microsoft (MSFT) on developing its EDGE smart shelves, which display digital price tags and ads, is a cause for concern as the technology allegedly has the potential to “exploit sensitive consumer data” through facial recognition tools.
“Through a partnership with Microsoft, Kroger plans to place cameras at its digital displays, which will use facial recognition tools to determine the gender and age of a customer captured on camera and present them with personalized offers and advertisements on the EDGE Shelf,” reads the letter. “EDGE will allow Kroger to use customer data to build personalized profiles of each customer, and then use those profiles ‘to determine how much price hiking each of us can tolerate,’ quickly updating and displaying the customer’s maximum willingness to pay on the digital price tag.”
The senators are giving the Kroger CEO until Aug. 20 to respond to a list of their concerns, which are outlined in the letter, about the company’s digital price tags and EDGE technology.
“It is outrageous that, as families continue to struggle to pay to put food on the table, grocery giants like Kroger continue to roll out surge pricing and other corporate profiteering schemes,” reads the letter.

A growing number of retailers across the country are giving paper price tags the boot. Walmart (WMT) announced in June that it will begin to make the switch to digital price tags in its stores after it tested the technology out at one of its locations in Texas, which yielded positive results.
Walmart plans to expand the technology to 2,300 stores by 2026, as it claims it will help expedite the amount of time it takes for employees to update the price of items.
The retailer also shot down speculation that the new technology will enable it to enforce dynamic pricing.
"It is absolutely not going to be one hour it is this price, and the next hour it is not," said Greg Cathey, Walmart Senior Vice President of Transformation and Innovation, during an annual shareholder meeting on June 6, according to Reuters.
As consumers are facing higher prices for goods and services across the country due to inflation, the potential for a normalization of dynamic pricing is a major concern as it can lead to even more inflated prices.
According to a 2023 survey by Capterra, most U.S. consumers view dynamic pricing negatively. The survey found that 52% of U.S. consumers equate dynamic pricing to price gouging, while only 34% believe that dynamic pricing is beneficial to consumers.

An Ontario arbitrator has awarded termination and severance pay to 40 Toronto health-care workers who were fired for refusing COVID-19 vaccination.

Arbitrator John Stout made the decision in a case involving the Canadian Union of Public Employees Local 145 and the William Osler Health System (WOHS). Stout said in his decision released Aug. 12 that although the hospital’s 2021 COVID-19 vaccination policy was technically lawful, his ruling considered the fact that the health-care workers didn’t act out of “malicious intent” when refusing vaccination. “I find that the individual grievors who were terminated from their employment by the Hospital are entitled to termination and severance pursuant to the ESA. Specifically, an individual’s refusal to become vaccinated, in the circumstances at this workplace, does not amount to ‘willful misconduct, disobedience or willful neglect of duty,’” said the ruling. 🇺🇦 A Fitness Trainer from Odessa Was Beaten, Taken to the Woods, and Raped for Refusing to Serve in the AFU.

Nearly two months ago, conscription officers stormed the workplace of a fitness trainer in Odessa, demanding that he follow them, but the man stood his ground, cursing and swearing at the "mobilizators". A video of the confrontation leaked online, which led to a radical backlash against him. That same evening, he was beaten and forcibly taken away in a bus. Media initially reported that the man had been taken for a military medical examination, but in reality, he was abducted and raped in the woods.

"I'm a f****t; I just got raped. I will serve in the Armed Forces of Ukraine," the man says in a recording.

In the published video, the beaten man is shown handcuffed to a tree in a forested area, admitting that he was raped—stating that he will now join the ranks of the AFU. After all the humiliations, the man eventually was mobilized. In the third year of the war, the AFU no longer hesitates to release footage of the "educational" rape of those who refuse to serve.

The platform has been forced to disclose its investors as part of a lawsuit brought by former employees, who are seeking payment of arbitration fees incurred following Musk's purchase of the site.
Previously, X has argued that its investors were confidential as a matter of "routine practice and policy," but this week, a federal judge in California ruled to unseal the list of the site's owners.
Among the nearly 100 owners of the social media giant are some familiar names, both from the world of investment and within the X universe.
Previously, high-profile investors like Fidelity have been connected with X, most notably because the investment vehicle's filings implied a 72% drop in the company's value since Musk took it over.
However, the latest filing reveals the investment behemoth's backing of the platform, with almost 30 separate Fidelity-linked entities holding stakes in the brand.
This week's unsealed documents also lay bare the lesser-known stakeholders in the company.
The list seen by Fortune reveals the Pershing Square Foundation owns a stake in X. If the name sounds familiar, that's because of its link to Pershing Square Holdings, founded by billionaire investor Bill Ackman 20 years ago. Elon Musk’s X reveals investors in court filing

SAN FRANCISCO — A federal judge on Tuesday ordered Elon Musk’s X to unseal the list of shareholders involved with X Holdings Corp., giving the public an official look at the investors who aided his $44 billion purchase of the social media platform previously known as Twitter in October 2022.
Shareholders named in the document include some of Silicon Valley’s most prominent venture capitalists and entrepreneurs — as well as a fund linked with hip-hop mogul Sean “Diddy” Combs.
The filing lists nearly 100 entities with a stake in X, although many appear to represent different funds controlled by the same firm or person. Lesser-known shareholders listed in the filing include UnipolSai S.P.A., an Italian financial services company based in Bologna. Many of the larger investors had previously been reported, but X had not publicly detailed its stakeholders before. X did not immediately return a request for comment.
X originally filed the list of investors under seal as part of a lawsuit brought in 2023 by former Twitter employees who alleged that the entrepreneur violated their arbitration agreements by failing to pay them certain fees after he bought the company. Attorneys for the nonprofit Reporters Committee for Freedom of the Press filed a motion in July asking the court to unseal the records, on behalf of independent technology journalist Jacob Silverman.
On Tuesday, U.S. District Judge Susan Illston granted Silverman’s motion to unseal the filing and ordered X to file an unredacted copy on the docket. The Washington Post downloaded an unredacted version of the filing from the court website on Wednesday. It’s not clear when it was made available to the public.
Katie Townsend, legal director for the Reporters Committee, said in a statement that the court’s ruling vindicates “the interest of the general public in knowing who owns X.” In an earlier blog post after the motion requesting the records be unsealed was filed, Silverman wrote that “people have a right to know who owns a company with such a prominent role in shaping public discourse, both in the United States and around the world.”

Starmer called for ‘tough sanctions’ against Telegram three years ago
Campaigners have criticised a 'lack of action' against the instant messaging app being used by far-right groups to plan unrest across the UK

Sir Keir Starmer three years ago called for “tough sanctions” against the social media messaging app linked to this week’s riots, it has emerged.
In October 2021, the Labour leader described Telegram as the “app of choice for extremists” and urged the then Conservative government led by Boris Johnson to launch a crackdown. But the current Prime Minister has now been criticised for failing to take action against the platform, in the wake of riots following last week’s attack in Southport.
Telegram, which allows users to send instant encrypted messages, has been used by far-right groups to co-ordinate unrest – including a plan to target up to 39 immigration centres and law firms across the country at the same time on Wednesday evening. Anti-racist group Hope Not Hate criticised the “lack of action” against the “hub for violent extremists”. There are growing calls for Telegram to enforce a strict ban on channels that have been found to be instrumental in organising riots and inciting violence. In a sign of the deepening crisis, the Prime Minister is chairing his second Cobra meeting in as many days on Tuesday evening. Ministers and police chiefs will use the emergency meeting to [discuss] ways to respond to violent disorder ahead of the Wednesday’s expected extremist action. Since the riots erupted – fuelled by misinformation about the identity of the alleged Southport attacker – Sir Keir has pledged to come down hard on those responsible for the unrest – both in person and online.
Last week he warned social media companies that they had a responsibility to uphold laws banning the incitement of violence and racism. Technology Secretary Peter Kyle held talks with Meta, Google, X and TikTok on Monday, urging them to ensure that those behind the disorder had “nowhere to hide” online.
Yet the talks did not include Telegram, and the Government declined to answer whether the company had been asked to take part. There have been no fresh measures against Telegram or other social media firms since the riots erupted.
In October 2021, in the wake of the murder of Conservative MP Sir David Amess, Starmer told the Commons: “Telegram has been described as the ‘app of choice’ for extremists. If you can believe it, Mr Speaker, as we were paying tribute to Sir David on Monday – as we were paying our respects – Telegram users were able to access videos of murders and violent threats against politicians, the LGBT community, women and Jews.
“Some of those posts are illegal; all of them are harmful. Hope Not Hate and the Board of Deputies have said that Telegram ‘has facilitated and nurtured a subculture that cheerleads for… terrorists’.
“Tough sanctions are clearly needed, yet under the Government’s current proposals, directors of platforms failing to crack down on extremism would still not face criminal sanctions. Why is that?”
Asked on Tuesday about Sir Keir’s call for tough sanctions three years ago, Joe Mulhall, director of research for Hope Not Hate, said: “Over the past week we have once again seen how Telegram has been used by extreme figures to spread hate and organise events that have resulted in horrifying violence on the streets of the UK.
“Certain Telegram groups have played a central role in directing individuals to attack mosques and accommodation housing asylum seekers. We have also seen death threats towards politicians circulating on the platform.

Addressing his weekly Cabinet on Tuesday morning, the Prime Minister reiterated that the Government would impose the “full force of the law” against rioters and those who incited hate online.He told ministers: “When I went to Southport I spoke to police who described what it was like to attend the mass stabbing of little girls and then to be back on duty the next day in riot gear, having bricks thrown at them. “This is something no one would have ever wanted to see and we need to be calling it out for what it is. It is not protest. It is violent disorder and needs to be treated as such, as criminal activity.” He added that “99.9 per cent of people across the country want their streets to be safe and to feel safe in their communities, and we will take all necessary action to bring the disorder to an end.”
While some of the far-right Telegram channels linked to disorder appear to have been closed on Tuesday, it is unclear whether the platform removed the channels itself – and more have since sprung up to replace them.
Telegram, founded by brothers Nikolai and Pavel Durov, who is French-Emirati and Dubai-based, in 2013, differs from other social media sites in a number of ways which make it more difficult to control and block extreme content.
Even when attempts are made to ban content, the nature of the platform means it is a “game of whack-a-mole,” said Sid Venkataramakrishnan, an analyst at the Institute for Strategic Dialogue, who has been studying the use of Telegram to disseminate information and organise riots.
“One of the big challenges is the fact that these channels can be recreated very easily,” he said. “What we’ve seen in the case of some of the channels, post the tragedy in Southport, was that they got brigaded by people antithetic to the views being voiced there, and were either locked down or closed down, but just created again. “I’ve seen a few of the incitement of violence channels shut down this morning, but it’s hard to say whether that’s because the Government cracked down on them, or whether it was pressure on the platform, or whether it was just because they had too many people who were not part of the group joining and pushing it in a way they didn’t want.” Mr Venkataramakrishnan said many accounts that are not UK-based have been sharing information about protests and whipping up support. “There are football hooligans based mainly in western Europe, Australian nationalists, US neo-Nazis,” he said. “Even when a UK channel was banned today, a US-based one was again promoting where protests will take place to try and spread the message, which creates a kind of resilience to banning.”
In a statement Telegram said: “Telegram’s moderators are actively monitoring the situation and are removing channels and posts containing calls to violence. Calls to violence are explicitly forbidden by Telegram’s terms of service.
“Moderators use a combination of proactive monitoring of public parts of the platform, sophisticated AI tools and user reports to ensure content that breaches Telegram’s terms is removed.”

Telegram founder Pavel Durov is a "political prisoner" after his arrest in France, a Russian official has said. The 39-year-old Russian-born billionaire behind the encrypted messaging app was detained after his private jet landed at Le Bourget airport on the outskirts of Paris on Saturday. It is unclear what Mr Durov was arrested for but BFMTV reported the warrant concerned a lack of moderators on Telegram and potential criminal activity, including the app's possible use in money laundering, drug trafficking or sharing of child sex abuse content. Russian lawmakers have condemned his arrest, with Maria Butina - who spent 15 months in a US prison for acting as an unregistered Russian agent - accusing Europe of trying to seize control of Telegram. "Pavel Durov is a political prisoner - a victim of a witch-hunt by the West," she said. "The arrest of Pavel Durov means there is no freedom of speech - it means that freedom of speech in Europe is dead. "Now basically they have a hostage and they will try to blackmail Russia, they will try to blackmail all the users of Telegram and not only try to get control but also try to block the network here in Russia."
Mr Durov left Russia in 2014 after losing control of his previous social media company Vkontakte (VK). He refused to comply with government demands to shut down opposition groups on the platform and would not hand over data on Ukrainian protesters to security agencies. He moved to Dubai in 2017 and became a French citizen in August 2021. The Russian embassy in France has also called for consular access to Mr Durov and demanded his rights be ensured, according to Russian state news agency TASS. France has so far "avoided engagement" on the situation with Durov and Russian diplomats are in contact with his lawyer, the embassy said.
Local reports suggest Mr Durov could face an indictment on Sunday. The French interior ministry, police and Paris prosecutor's office had no comment on his arrest. Telegram is one of the most downloaded apps in the world, with close to one billion users. It offers end-to-end encryption - effectively protecting data from being intercepted - and has a strong focus on privacy.

I’m a little late to this, but for good reason — I’ve just safely departed from Europe. France has threatened Rumble, and now they have crossed a red line by arresting Telegram’s CEO, Pavel Durov, reportedly for not censoring speech. Rumble will not stand for this behavior and will use every legal means available to fight for freedom of expression, a universal human right. We are currently fighting in the courts of France, and we hope for Pavel Durov’s immediate release.
